Zoning Board of Appeals Minutes July 18, 2012
These minutes are not verbatim – they are the secretary’s interpretation of what took place at the meeting – Open Meeting Law – Section III.

Mr. Conner called the meeting to order and explained the procedures for the evening

Public Hearing – Case No. 3674

Sitting:  Mr. Conner, Mr. Keohan, Mr. Main, Mr. Conroy, and Mr. Simpson

Mr. Keohan, the Clerk, read the legal advertisement into the record.

Mr. Keohan then read a letter from Attorney Theodore L. Bosen, Sagamore Beach, MA, the petitioner’s representative, requesting a continuance for their application for a Special Permit per Section 205-18, Paragraph B3 and 4, and Section 205-40, Paragraph D1, subject to Environmental Design Conditions in order to remove 85,000 cubic yards of gravel.  

There was much discussion as to whether or not the case should be continued due to the reasons requested in the attorney’s letter presented to the Board. Some members felt that the appropriate groups and their responses were adequate to proceed.  According to the applicant’s representative, she may not actually need a Special Permit, which was firmly disagreed with by the Board members.

Mr. Keohan motioned to continue Case No. 3674 to September 19, 2012 at 7:30 PM.  Mr. Conroy seconded. Agreed (3) in favor, (2) against.

Mr. Keohan, the Clerk, read the legal advertisement into the record.

Mr. Keohan then read a letter from Attorney Edward T. Angley, the petitioner’s representative, requesting a continuance for their application for a Special Permit per Section 205-18, Paragraph B4, 3F, and 2G and Section 205-40, Paragraph D1, subject to Environmental Design Conditions in order to remove 256,000 cubic yards of gravel.

Mr. Main motioned to continue Case #3677 to September 5, 2012 at 8:00 PM.  Mr. Keohan seconded.  Agreed unanimously (5-0)

No further business came before the Board in open session.

Mr. Main motioned to adjourn the public hearing.  Mr. Conroy seconded.  Agreed unanimously (6-0).
